INVITATION TO A TWO-PACKAGE OPEN TENDER FOR THE SUPPLY OF 18-INCH (450 MM) DR11 PIPES AND FLANGE STUB ENDS FOR DR9 AND DR17 PIPES

The “Kumtor Gold Company” CJSC (hereinafter referred to as “KGC”) invites You to participate in a two-package open tender for the supply of 18-inch (450 mm) DR11 pipes and flange stub ends for DR9 and DR17 pipes.

The pipes and stub ends specified in the commercial proposal must be from the same manufacturer.

Main requirements for submission of qualification documents:

  1. Documents must be sent strictly to the following email address: [email protected]
  2. Please note that the size of one email must not exceed 25 MB; if exceeded, the documents must be sent in a second email with the same subject line. Documents must be submitted in PDF format as one archive file (RAR or ZIP).
  3. All parties wishing to participate in the selection process must complete the Tender Application and forms in accordance with Appendices No. 1, No. 2, No. 3, No. 4 and No. 5 to the Invitation, attach the required signed and stamped copies of documents, and send them electronically to the email address.
  4. Tender participants must submit their application in Russian or English in accordance with the tender requirements and send it to the specified email address. If the documents are prepared in another language, they must be submitted with a notarized translation into Russian or English. Russian is the preferred language.
  5. All documents submitted as part of the selection process shall be treated as confidential.
  6. By submitting its proposal, the Participant thereby confirms its agreement with all terms and conditions specified in the Company’s requirements.
  7. Messages must have the following subject lines:

– for the first package: “Qualification and Technical Proposals [company name]”;

– for the second package: “Price Proposal [company name]” (access to the file must be password-protected and it must not be opened at the first stage; the password must be sent after the Customer’s request by email).

and must be sent to the address specified above.

Required technical documents:

  1. Product passport containing:
  • information about the manufacturer.
  • product name, size/type, batch number and date of manufacture.
  • main technical specifications.
  • main geometric parameters and drawings (or dimensional diagrams).
  • factory quality control and test results.

Required documents to be submitted:

For residents of the Kyrgyz Republic:

  1. Certified copy of the original Charter;
  2. Certified copy of the original Certificate / electronic extract of the certificate of state registration (re-registration) of a legal entity;
  3. Certified copy of the Certificate of state registration of an individual as an individual entrepreneur / copy of the Patent (voluntary or mandatory) for the relevant type of activity (valid as of the submission date), as well as a copy of the passport/identification card;
  4. For legal entities: information confirming the absence of tax payment and insurance contribution arrears to the budget of the Kyrgyz Republic;
  5. Scanned copies of the original balance sheet with all attachments, certified by the organization’s seal and signature, for the previous 2 (two) calendar years or the Unified Tax Return;
  6. Certificate of tax registration;
  7. Permitting documents (licenses, permits, certificates) for types of activity, if available;
  8. Certified copy of the original document confirming the authority of the head (order appointing the head, extract from the minutes of the participants’ meeting on appointment of the head, decision of the sole participant of the legal entity). If another person acts on behalf of the Participant, a duly certified copy of the power of attorney for the person authorized to sign contracts and other documents must be provided;
  9. Experience in supplying similar products over the last 2 years — attach copies of contracts or a reference list;
  10. Residents must submit the commercial proposal in the national currency, without reference to a foreign currency exchange rate.
  11. If there are comments on the draft contract, changes must be made in track changes mode.

For non-residents (participants from other countries):

  1. Certified copy of the original registration and constituent documents;
  2. Permitting documents (licenses, permits, certificates) for types of activity, if available;
  3. Certified copy of the original document confirming the authority of the head (order appointing the head, extract from the minutes of the participants’ meeting on appointment of the head, decision of the sole participant of the legal entity). If another person acts on behalf of the Participant, a duly certified copy of the power of attorney for the person authorized to sign contracts and other documents must be provided;
  4. Financial statements certified by the organization’s seal and signature for the previous 2 (two) calendar years;
  5. Experience in supplying similar products over the last 2 years — attach copies of contracts or a reference list;
  6. If there are comments on the draft contract, changes must be made in track changes mode.

Procedure for submitting the tender application

Participants shall submit documents in two separate packages, with both packages submitted simultaneously to the email address specified above:

  • Package No. 1 — qualification and technical proposals (submitted without a password);
  • Package No. 2 — commercial proposal (access to the file must be password-protected and it must not be opened at the first stage; the password must be sent after the customer’s request by email).

Based on the results of the first stage, a list of participants admitted to the second stage shall be formed.

The following participants shall not be admitted to the second stage:

  • Participants who have not provided a complete package of documents;
  • Participants who have submitted a commercial proposal without a password or sent the password before it was requested;
  • Participants who fail to provide the password for the second package after the Customer’s request;
  • Participants who submit documents after the deadline specified in the Invitation;
  • Participants who have not passed accreditation by the Customer’s Security Service and Finance Department;
  • Participants who have not passed the technical evaluation or have not provided the technical specification.
  • In other cases, provided for by KGC’s internal procurement regulations.

Stage Two – Evaluation of the Bid Proposal

  • Only participants who have successfully passed Stage One shall be admitted to Stage Two.;
  • The Participant’s Price Proposal shall be completed in the form attached as Appendix No. 5 to the Invitation (where comments are included, amendments may be made in editing mode). Participants may supplement the form with additional terms and conditions they consider important or that have not been addressed therein, provided that the technical specification requirements are complied with.
  • The price of the products quoted by the Participant shall include all costs and expenses, including all applicable taxes, duties, fees, delivery to the Purchaser’s warehouse, and any other charges imposed in accordance with the legislation of the Kyrgyz Republic, as well as any other expenses incurred in the performance of contractual obligations, taking into account the service period and related services specified in the Contract.
  • The successful bidder shall be the Participant whose proposal meets the established qualification and technical requirements and offers the most advantageous combination of price, quality, and delivery terms;
  • In the event that an advance payment is requested, the supply contract shall require the provision of a bank guarantee in the amount of the advance payment.
  • The Supplier shall provide a Performance Bond in the form of either a bank guarantee or a transfer of funds to the Purchaser’s settlement account, in an amount equal to 2% of the total contract value.
  • KGC reserves the right to request additional supporting documents or to verify the information provided. If any false or inaccurate information is identified, the proposal shall be rejected.

Should there be any questions regarding this Invitation, a Participant may request clarification by contacting [email protected] no later than three (3) business days prior to the deadline for the submission of qualification and technical documents. Clarifications shall be provided to the requesting Participant via the email address from which the request was received within three (3) calendar days following receipt of the request.

The validity period of the bid proposal shall be not less than sixty (60) calendar days.

After the submission deadline has expired, Participants shall not be permitted to make any amendments or additions to their proposals.

Bid proposals submitted by Participants after the specified deadline shall not be accepted or considered. (Participants are strongly encouraged to submit their proposals well in advance of the deadline and not to postpone submission until the last moment in order to avoid possible technical delays).

KGC reserves the right to reject any application that does not comply with the stated requirements. Submission of documents does not guarantee participation in subsequent stages of the procurement process.

The Customer may extend the deadline for submission of qualification and technical documents if amendments are made to this Invitation. The Customer may also cancel the tender, in which case the Customer shall notify participants by publishing the relevant information on its official website at https://www.kumtor.kg/en/, where the announcement of this tender was originally posted.
